Customers are responsible for providing a complete and accurate delivery address.

Costs resulting from an incorrect address, incomplete address, address correction, rerouting request, refused shipment, undeliverable shipment, or reshipment may be charged to the customer or deducted from an applicable refund.

SECTION 9 — INTERNATIONAL ORDERS

International shipping is available only to destinations presented as available at checkout.

A country or region that does not appear in the checkout country list is not an available shipping destination.

International customers are responsible for determining whether a product may lawfully be imported, possessed, or used in the destination country.

To the fullest extent permitted by law, unused points may expire or be canceled when:

  • An account is closed;
  • The program is terminated;
  • Fraud or abuse is suspected;
  • Points were credited in error;
  • An order is canceled, refunded, returned, or charged back; or
  • Program rules are violated.

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, MASS, OR REPRESENTATIVE ACTION CONCERNING THESE TERMS, THE WEBSITE, A PRODUCT, OR A TRANSACTION.

This provision does not prevent either party from seeking relief in an individual action or from exercising a right that cannot legally be waived.

New Jersey recognizes that a clearly written class-action waiver may be enforceable even without mandatory arbitration, although enforceability still depends on ordinary contract-law principles and whether the provision is unconscionable.

SECTION 24 — GOVERNING LAW AND VENUE

These Terms and any dispute arising from them, the website, a product, an order, or a transaction are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

Subject to applicable mandatory law, the parties consent to the exclusive personal jurisdiction and venue of the state and federal courts located in or serving Passaic County, New Jersey.

No mandatory arbitration provision applies.

Each party will bear its own attorneys’ fees and costs unless applicable law, a valid contract, or a court order requires otherwise.
